Introduction

The protection of your personal rights when processing personal data is an important concern for the companies of the MAN Truck & Bus Group (hereinafter referred to as "MAN" or "we"). We process personal data in accordance with the legal provisions of the country in which the controller is located (e.g., within the EU, the GDPR).

In addition, companies of the MAN Truck & Bus Group have committed themselves to comprehensive and uniform protection of personal data by means of a binding Group policy. This ensures a level of protection within MAN worldwide that is comparable to that in the European Union.

Controller

The controller within the meaning of data protection law is the MAN company that processes your data within the framework of an existing or impending contractual relationship.

Purposes of the processing

In the following we provide you with an overview of the purposes of our processing activities.

Implementation of sales promotion and image improvement measures:

Data origin - Data subject

Your personal data are usually collected directly from you.

Obligation to provide data

We need your data to carry out the contractual relationship and to fulfil legal obligations. Without your data we cannot establish a business relationship with you.

Data categories

The data processed fall under the following data categories:

  • Private contact and identification data: e.g. private address, last name, first name, gender, email address, telephone number, mobile phone number, date/place of birth, identification numbers, nationality
  • Professional contact and (work) organisational data: e.g. business address, surname, first name, gender, email address, telephone number, mobile phone number, company, area, department, cost centre, personnel numbers, responsibilities, functions
  • Data on personal/professional circumstances & characteristics: e.g. data on spouse or children, marital status, voluntary work, job title, professional career, length of service, tasks, activities, entry and exit dates, qualifications, evaluations/assessments, photos, video/audio recordings, sensor-generated data

Legal basis

The processing of your data is legitimised by the following legal bases:

  • Contract fulfilment: The processing is necessary for the performance of a contract with the data subject or in the context of pre-contractual measures.

Recipient categories

To fulfil the aforementioned purposes, we may pass on your data to the following recipients:

  • External processors (e.g., organisation of trade fair events, conducting customer satisfaction surveys, sending email newsletters, hosting and operating CRM systems, digitising paper invoices, providing a supplier platform)
  • Responsible companies of the Volkswagen Group (affiliated companies)

Data storage and deletion

As a general rule, we delete your personal data as soon as they are no longer required for the purposes stated above.

In particular, your personal data will be stored as long as

  • a business/contractual/employment relationship exists,
  • we are legally obliged to do so (proof and retention obligations),
  • we need them to assert, exercise or defend legal claims,
  • this is appropriate in the context of the use of information/communication systems (e.g. websites).

No automated decision-making

No automated decision-making takes place.

An automated individual decision – including profiling – is a process in which decisions are made based on algorithms or machine learning that legally or significantly affect an individual without human review or intervention.

Your rights

In addition to the right to information about the data concerning you and the right to rectification of your data, you also have the right to erasure and the right to object to the processing or the right to restriction of the processing of your data, provided that there are no statutory provisions to the contrary. You also have the right to data portability.

If we collect and process your personal data based on your consent, you also have the right to revoke the consent you have given with effect for the future at no additional cost. Your revocation does not affect the lawfulness of the data processing carried out on the basis of the prior consent until revocation.

Where necessary, we will need to verify your identity before we can process your applications.

If, in spite of our best endeavours to ensure the correctness and actuality of the data, incorrect information is stored, we will correct this information after receiving appropriate instruction to do so.

In the event of complaints, there is the possibility of contacting a data protection supervisory authority.

Security

Your data are protected by MAN using technical and organisational security measures to prevent accidental or intentional manipulation, loss, destruction or access by unauthorised persons.

Our security measures are regularly improved in line with technological developments.

This privacy policy may be updated from time to time. We therefore recommend that you read it from time to time. If necessary, we will also inform you of any changes.
