6. RESPONSIBILITIES, WARRANTIES AND MODIFICATIONS
Responsibilities
MAN Automotive (South Africa) Proprietary Limited shall not be liable if force majeure or other weather or global health-related events prevent the selected participants from participating in the handover in Johannesburg in whole or in part.
Warranties and modifications
In the event of force majeure, as mentioned above, MAN Automotive (South Africa) Proprietary Limited reserves the right to modify these terms and conditions without incurring any liability, and the participant accepts these possible modifications from the moment of registration and during his or her participation in the competition.
MAN Automotive (South Africa) Proprietary Limited also reserves the right to cancel, terminate or modify the competition if it does not run as planned: Violations, unauthorised interventions, fraud, technical problems or other reasons beyond the control of MAN Automotive (South Africa) Proprietary Limited that alter or affect the administration, security, fairness, integrity or operation of the competition. Incomplete or incorrect submissions will be rejected without MAN Automotive (South Africa) Proprietary Limited being held liable. False information provided by a participant will result in exclusion from the competition, without MAN Automotive (South Africa) Proprietary Limited being held liable. MAN Automotive (South Africa) Proprietary Limited reserves the right to moderate retrospectively and to refuse admission or even exclude participants who do not comply with these conditions.
This competition and these terms and conditions are governed by South African law.
Dispute Resolution
Any dispute, controversy, or claim arising out of or in connection with this Campaign, including any question regarding its existence, validity, interpretation, breach, or termination, shall be finally resolved by arbitration.
The arbitration shall:
- Be conducted in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA) (or other agreed body);
- Take place in a city to be decided on between the parties, South Africa;
- Be conducted in the English language;
- Be presided over by a single arbitrator, appointed by agreement between the Parties or, failing such agreement, by AFSA;
- Be final and binding on the Parties, and the decision of the arbitrator may be made an order of court.
Nothing in this clause shall prevent a Party from seeking urgent interim or interlocutory relief from a court of competent jurisdiction
In the event of persistent disputes concerning the interpretation and application of these conditions and if no amicable settlement can be reached, the competent courts will be consulted
